Deferred Disposition
A defendant may be able to dismiss their violation by requesting Deferred Disposition.  Deferred Disposition is a probation period in which the defendant must keep a clean driving record for a period of time.  If the defendant does not receive a citation for that probation period, the citation is dismissed and NOT reported to the state. To be eligible for Deferred Disposition, a defendant must come to the court office prior to their court date or appear in court and meet the following requirements:

  • Defendant must enter a plea of guilty or no contest before the judge
  • Defendant must request deferred disposition
  • Defendant must not be on a deferred disposition with another case on the request date
  • Defendant must pay a special expense fee that does not exceed the amount of the fine and court costs

Non-Moving Violations
If a defendant receives a citation for no inspection sticker, no vehicle registration, expired driver’s license or defective equipment, the citation MAY be dismissed in the court office or on their court date if the expiration date is less than 60 days prior to the date the citation was issued and the violation is corrected within 20 days.  There will be a $20.00 dismissal fee (for each violation) required at the time proof of compliance is provided.

Financial Responsibility
If a defendant had liability insurance that was valid at the time the citation was issued, he/she must present proof (entire policy or letter from insurance company) in the court office before the court date or appear in court on their scheduled date and time.  The charges may be dismissed upon verification of insurance coverage.

Contesting a Charge
If a defendant wishes to contest a charge(s) they received, they must appear on their court date to enter a plea of not guilty.  Once the plea is entered, the judge will set the case for trial.  A defendant has the option of requesting a judge trial or a jury trial.
